These terms explain the conditions for using KidneyPass and its public reference tools.

Acceptance and who we are
By accessing or using kidneypass.com, you agree to these terms. If you do not agree, do not use the site. KidneyPass organizes public information about US dialysis facilities into reference pages and comparison tools.

Data sources and accuracy
The facility directory is based on the public-domain CMS Medicare dataset 23ew-n7w9. KidneyPass refreshes the data periodically. It can be stale, incomplete, or inaccurate. When a facility is missing from a later CMS file, KidneyPass marks its record inactive rather than deleting it.
A Medicare rate shown on KidneyPass is a national payment benchmark, not the price at a specific facility. KidneyPass does not publish a verified facility-level price. Verify current facility details on Medicare.gov, and ask the facility and your insurer about current prices. See the data page for provenance and freshness details.
No warranties
KidneyPass is provided “as is” and “as available.” We make no warranties, express or implied, about accuracy, completeness, timeliness, availability, fitness for a particular purpose, or non-infringement.
Limitation of liability
To the maximum extent permitted by law, KidneyPass will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss resulting from use of, or inability to use, the site or reliance on its information.
Intellectual property
KidneyPass site text and presentation belong to KidneyPass. The underlying CMS dataset is in the public domain, and commercial reuse of that dataset is allowed. Bulk data users should obtain it directly from data.cms.gov.
Acceptable use
Do not disrupt or attempt to compromise the site, interfere with another visitor's use, or misrepresent that you or your service is affiliated with, endorsed by, or acting for KidneyPass.
Third-party sites
Links to CMS, Medicare, facilities, and other third parties are provided for reference. KidneyPass does not control or endorse their content, availability, terms, or privacy practices.
Changes to these terms
We may update these terms when the site or its services change. The effective date at the top will show when the current version began to apply. Using the site after an update means the updated terms apply to that use.
Severability
If any part of these terms is found unenforceable, the remaining parts will remain in effect to the extent permitted by law.
